Welcome to Gavathi. These Terms & Conditions (“Terms”) govern your access to and use of the Gavathi website, mobile applications, products, services, ordering facilities and other digital services operated under the Gavathi brand (“Platform”). By accessing the Platform, creating an account, placing an order or using our services, you agree to these Terms. If you do not agree with these Terms, please do not use the Platform.
1. About Gavathi
Gavathi is a rural-inspired Indian brand built around the philosophy “Authentic Taste, Rural Heart.” Through our Platform, Gavathi may offer products and services across categories including bakery and cakes, sweets and traditional delicacies, dairy products, snacks and regional foods, honey, grains and agricultural products, dry fruits, gifting and corporate gifting, bamboo, wooden, clay, glass and natural-material products, handicrafts, rural lifestyle products, kitchenware, dinnerware, textiles, garments, artisan products, and other products and services introduced by Gavathi from time to time. Availability may differ depending on location, season, inventory, regulatory requirements and delivery feasibility.
2. Eligibility
You must be legally capable of entering into a binding contract under applicable law to independently use the Platform for purchases. Where a minor uses the Platform, such use is under the supervision of a parent or legal guardian as required by applicable law. You are responsible for ensuring that the information provided while creating an account or placing an order is accurate and current.
3. User Account
Certain Gavathi services may require you to create an account. You are responsible for maintaining the confidentiality of your login credentials, providing accurate contact and delivery information, preventing unauthorized access to your account, and informing Gavathi if you suspect unauthorized use. Gavathi reserves the right to suspend or restrict an account where we reasonably suspect fraud, misuse, unlawful activity, security threats or violation of these Terms.
4. Product Information
We make reasonable efforts to accurately display product descriptions, ingredients, dimensions, weights, photographs, packaging and other relevant information. Some Gavathi products are handmade, handcrafted, naturally sourced or prepared in small batches. Reasonable variations may therefore occur in colour, shape, texture, grain, pattern, dimensions, weight, decoration and natural-material appearance. Such variations can be particularly common with bamboo, wood, clay, leaves, handmade products and artisan goods and do not necessarily constitute a defect.
5. Food Products
Food products are to be consumed according to the storage instructions, best-before/use-by information and other instructions supplied with the product. Customers are responsible for reviewing ingredient and allergen information before consumption. Our products may contain or be prepared in facilities handling common allergens such as milk, nuts, peanuts, gluten-containing cereals, soy and other allergens. Customers with serious food allergies or dietary restrictions are encouraged to contact Gavathi before ordering where appropriate.
6. Product Images
Images displayed on the Platform are intended to represent our products as accurately as reasonably possible. Actual products may differ slightly because of handmade preparation, natural ingredients, seasonal availability, screen/display differences, artisan craftsmanship, and natural variations in bamboo, wood, clay and similar materials. For customized cakes, sweets, gift boxes and handcrafted products, reference images are generally indicative unless Gavathi expressly agrees otherwise.
7. Pricing
All prices displayed on the Platform are shown in the applicable currency and may include or exclude taxes, delivery charges, packaging charges or other applicable fees as clearly disclosed during checkout. Gavathi may change prices from time to time. A price change will not ordinarily affect an order already accepted by Gavathi, except where correction is required due to an obvious pricing or technical error and permitted by applicable law.
8. Orders and Acceptance
Placing an order does not necessarily mean that the order has been accepted. An order is subject to product availability, serviceability of the delivery location, successful payment, production capacity, verification requirements, regulatory restrictions and other operational considerations. Gavathi may reject or cancel an order where reasonably necessary, including because of product unavailability, payment failure, incorrect pricing, suspected fraud or inability to fulfil the order. If Gavathi cancels a prepaid order, the eligible amount will be refunded according to the applicable refund policy.
9. Customized and Personalized Products
Certain Gavathi products may be made specifically for a customer, including customized cakes, personalized gift boxes, engraved bamboo or wooden products, corporate gifts, personalized messages or poems, special packaging and made-to-order products. Once production or personalization has begun, cancellation, modification, return or refund may not be possible except where required by law or where the delivered product qualifies under the applicable policy. Customers are responsible for checking names, dates, messages, photographs and other personalization information before confirming the order.
10. Payments
Available payment methods are displayed during checkout and may include eligible online payment methods and other options supported by Gavathi. Payments may be processed through third-party payment service providers. Gavathi does not necessarily directly store complete card, UPI or banking credentials. Customers must never share OTPs, passwords, PINs or other confidential banking credentials with anyone claiming to represent Gavathi.
11. Delivery
Delivery availability and estimated delivery times depend on delivery location, product category, preparation time, traffic, weather, courier/rider availability, festivals, high-demand periods and events outside Gavathi’s reasonable control. Delivery times displayed on the Platform are estimates unless expressly guaranteed. Customers are responsible for providing a complete and accurate delivery address and a reachable telephone number.
12. Fresh, Perishable and Temperature-Sensitive Products
Cakes, dairy products, sweets and certain other products may be perishable or temperature-sensitive. Customers are responsible for receiving, refrigerating, storing and consuming these products according to the instructions provided. Where a customer requests delayed receipt, leaves a product unattended after delivery or stores it contrary to supplied instructions, Gavathi may not be responsible for resulting deterioration to the extent permitted by law.
13. Cancellation, Return and Refund
Eligibility for cancellation, replacement, return or refund depends on the product category and circumstances. Perishable, freshly prepared, customized, personalized or hygiene-sensitive products may not ordinarily be returnable merely because of a change of mind. Customers are requested to contact Gavathi promptly if a product is incorrect, materially damaged during delivery, defective, spoiled at the time of delivery or materially different from the confirmed order. Gavathi may request photographs, videos, packaging information, order details or other
reasonable evidence to investigate the issue. Detailed conditions are governed together with the Gavathi Cancellation, Return & Refund Policy. Nothing in these Terms excludes rights that cannot legally be excluded under applicable consumer law.
14. Natural and Handcrafted Packaging
One of Gavathi’s distinctive features is the use of natural and reusable materials. Depending on the product, packaging may use bamboo, wood, clay, glass, leaves, fabric, paper and other natural materials. Natural products may contain variations in grain, shade, texture, markings and finish. Minor natural variations that do not materially affect functionality are not considered manufacturing defects. Customers are responsible for following any care instructions provided for reusable packaging.
15. Packaging and Food Contact
Decorative bamboo, wooden, clay or other packaging is not automatically suitable for direct food contact, microwave use, oven use, dishwasher use or prolonged food storage. Customers are responsible for following the specific usage instructions accompanying the product. Where necessary, food may be contained within a separate food-safe inner container or barrier.
16. Live Kitchen / Preparation Experience
Gavathi may introduce features that allow customers to view portions of the preparation, packing or fulfilment process through photographs, videos, recorded content or live streams. Such features may be offered for transparency and customer experience purposes. Availability is not guaranteed for every order. For privacy, security, food-safety or operational reasons, Gavathi may restrict, delay, interrupt or discontinue such viewing features. Customers must not misuse, manipulate, unlawfully record, redistribute or exploit access provided through restricted live-kitchen features.
17. Promotions, Coupons and Offers
Promotional codes, discounts, vouchers and special offers may be subject to additional terms including validity periods, minimum order amounts, product restrictions, geographic restrictions, customer eligibility and usage limits. Unless expressly permitted, promotions cannot be combined. Gavathi may withdraw or modify promotions subject to applicable law.
18. Corporate and Bulk Orders
Corporate gifting, event orders, bulk purchases and large customized orders may be governed by additional commercial terms, quotations or agreements. Such terms may specify minimum quantities, advance payments, design approvals, production schedules, delivery schedules, cancellation conditions and custom branding requirements. Where specifically agreed commercial terms conflict with these general Terms, the specifically agreed terms apply to that transaction to the extent of the conflict.
19. International Orders and Exports
Gavathi may make selected products available for international delivery. Not every product available in India is necessarily eligible for export. International orders may be subject to import/export regulations, customs requirements, product restrictions, destination-country regulations, duties and taxes, shipping restrictions, documentation requirements, food and agricultural regulations, and packaging or phytosanitary requirements. Applicable customs duties, import taxes and similar charges are handled as disclosed during checkout or under the applicable shipping terms. Gavathi reserves the right to restrict international delivery where legal, safety, quality or logistical requirements cannot reasonably be satisfied.
20. Intellectual Property
Unless otherwise stated, the Gavathi name, logos, brand identity, website content, original graphics, photographs, packaging artwork, product presentation, text and other intellectual property displayed through the Platform are owned by or licensed to Gavathi and are protected to the extent available under applicable intellectual-property laws. No person may reproduce, commercially exploit, copy or use protected Gavathi intellectual property without appropriate authorization. Nothing in these Terms claims exclusive rights over material in the public domain, traditional cultural expression not capable of exclusive ownership, or third-party intellectual property.
21. Reviews and User Content
Customers may be able to submit reviews, photographs, comments or other content. By submitting content, you confirm that you have the necessary rights to provide it and that it does not violate another person’s rights, contain unlawful or malicious material, infringe intellectual property, violate privacy or contain material prohibited by applicable law. Where legally permitted, you grant Gavathi a non-exclusive licence to use content voluntarily submitted for publication, promotion and operation of the Platform, subject to our Privacy Policy and applicable consent requirements.
22. Prohibited Use
You must not use the Gavathi Platform to commit fraud, attempt unauthorized access, introduce malicious software, interfere with Platform operation, misuse promotional offers, impersonate another person, scrape or commercially reproduce protected content without authorization, engage in unlawful activities or violate third-party rights. Gavathi may restrict access where there is reasonable evidence of misuse.
23. Third-Party Services
The Platform may rely on third parties for payments, delivery, logistics, maps, communications, analytics and cloud infrastructure. Third-party services may also be governed by their respective terms and privacy policies. Gavathi remains responsible for its own obligations and does not exclude liability that applicable law places on Gavathi merely because a third-party service provider is involved.
24. Privacy
Personal information collected through Gavathi is handled according to the Gavathi Privacy Policy and applicable law. Customers are encouraged to read the Privacy Policy carefully to understand how information may be collected, used, stored and shared.
25. Food Safety and Customer Responsibility
Gavathi aims to follow applicable food-safety and hygiene requirements. Customers are responsible for following storage, reheating, refrigeration, handling, allergy and consumption instructions supplied with products. Products must not be consumed after their applicable use-by/best-before period where doing so would be unsafe or contrary to instructions.
26. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so is prohibited by applicable law. To the extent legally permitted, Gavathi is not responsible for indirect or consequential losses arising from circumstances beyond its reasonable control. Any limitations contained in these Terms remain subject to applicable Indian consumer-protection and other mandatory laws.
27. Force Majeure
Gavathi is not responsible for delay or failure caused by circumstances beyond its reasonable control, which may include natural disasters, floods, severe weather, government restrictions, transport disruption, strikes, epidemics or public-health emergencies, internet or infrastructure failures and supply-chain disruption. Where possible, Gavathi will take reasonable steps to minimize the impact on affected orders.
28. Changes to These Terms
Gavathi may update these Terms to reflect changes in products or services, technology, business operations, regulatory requirements or legal requirements. The latest version will be published on the Platform with an updated “Last Updated” date. Material changes will be communicated where required by applicable law.
29. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Subject to applicable consumer-protection laws and mandatory dispute-resolution rights, disputes relating to these Terms will be subject to the jurisdiction of the competent courts specified by Gavathi’s registered business location Nagpur.
