This Privacy Policy explains how Gavathi (“Gavathi”, “we”, “us” or “our”) collects, uses, stores, shares and protects personal information when you visit or use our website, mobile applications, ordering services, customer support channels and other Gavathi services (collectively, the “Platform”). By using the Platform, you acknowledge the practices described in this Privacy Policy. Where consent is required by applicable law, Gavathi obtains consent before processing personal information for the relevant purpose.

Depending on how you use Gavathi, we may collect information such as your name, mobile number, email address, delivery and billing address, account information, order history, product preferences, customer-support communications, feedback, reviews, transaction references, device and browser information, IP address, approximate location, Platform activity and other information you voluntarily provide. We collect only information reasonably connected with operating, improving, securing and providing our services, subject to applicable law. 

  1. Payment Information 

Payments may be processed through authorized third-party payment service providers. Gavathi does not necessarily directly store complete card numbers, UPI PINs, banking passwords, OTPs or similar confidential authentication credentials. Payment providers process payment information according to their own security practices, terms and privacy policies. Never share an OTP, PIN or password with anyone claiming to represent Gavathi.

Where location-based functionality is enabled, Gavathi may use location information to determine delivery availability, show relevant products or services, calculate delivery estimates, support order fulfilment and improve the customer experience. Precise device location is accessed only where the Platform requests it and applicable permissions are granted. You can manage device-level location permissions through your device settings.

Gavathi may use personal information to create and manage accounts; process and deliver orders; provide customer support; communicate order and service updates; process payments and refunds; personalize the Platform; prevent fraud and misuse; maintain security; improve products, packaging, services and customer 

experience; conduct analytics; comply with legal obligations; resolve disputes; and send promotional communications where permitted by law and according to your communication preferences. 

  1. Order and Delivery Information

To fulfil an order, Gavathi may share necessary information such as customer name, contact details, delivery location and order-related information with delivery partners, logistics providers, fulfilment personnel or other service providers involved in completing the transaction. Such sharing is limited to information reasonably required for the relevant service and remains subject to applicable law and contractual or operational safeguards. 

  1. Customized Products and Gifting 

When you order personalized cakes, gift boxes, engraved products, corporate gifts, poems, greetings or other customized products, Gavathi may process the names, messages, photographs, designs or other personalization information you provide. This information is used to create and fulfil the requested product and may be retained for an appropriate period for order records, customer support, dispute handling or repeat-order functionality, subject to applicable law and your rights. 

  1. Live Kitchen and Preparation Features 

Gavathi may introduce live-kitchen, preparation, packing or fulfilment experiences using photographs, video, recorded content or live streams. These features are designed to provide transparency and enhance customer experience. Gavathi takes reasonable measures to avoid unnecessarily exposing personal information of employees, customers or other individuals. Access may be restricted, interrupted or disabled for privacy, security, operational or food-safety reasons.

The Platform may use cookies, SDKs, pixels and similar technologies to maintain sessions, remember preferences, understand Platform usage, measure performance, improve functionality, prevent fraud and, where permitted, support relevant marketing. Gavathi may use analytics services to understand how customers interact with the Platform, including pages viewed, features used, general device information, referral sources and performance data. Analytics helps Gavathi identify technical issues, improve navigation, understand demand and enhance products and services. Where required, analytics technologies are used subject to consent or other lawful processing grounds. 

  1. Marketing Communications 

Where permitted by law, Gavathi may send information about new products, launches, regional collections, gifting, offers or other updates through email, SMS, messaging services, push notifications or similar channels. You can withdraw from optional promotional communications through available unsubscribe or preference controls. Transactional and service communications relating to active orders, security or important account matters may continue where necessary.

Gavathi does not sell personal information as a commodity. Personal information may be shared with service providers that support payments, delivery, logistics, hosting, communications, analytics, security, customer support and other Platform operations; with professional advisers where necessary; with authorities where legally required; or in connection with a legitimate corporate transaction, subject to applicable safeguards. Gavathi limits sharing to purposes connected with the relevant service, legal requirement or legitimate business operation.

For international orders, personal information may need to be shared with international couriers, customs authorities, logistics providers, payment providers or other parties involved in export, import and delivery. Information may consequently be processed outside India. Gavathi handles such transfers in accordance with applicable legal requirements and any restrictions governing cross-border transfer of personal data.

Gavathi uses reasonable administrative, technical and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration or disclosure. These measures may include access controls, secure communications, authentication, monitoring, backups and security practices appropriate to the nature of the information. No internet-based system can guarantee absolute security, and customers are also responsible for protecting their account credentials and devices.

Gavathi retains personal information only for as long as reasonably necessary for the purposes for which it was collected, including order fulfilment, customer support, accounting, taxation, fraud prevention, legal compliance, dispute resolution and legitimate operational requirements. Retention periods may differ by category of information and applicable law. Information that is no longer required is deleted, anonymized or otherwise handled according to applicable requirements.

The Gavathi Platform is primarily intended for customers who are legally capable of entering into transactions. Where services are used by a minor, involvement of a parent or legal guardian may be required under applicable law. Gavathi does not knowingly seek to collect children’s personal information beyond what is necessary for a lawful service. A parent or guardian may contact Gavathi regarding a child’s personal information.

Subject to applicable law, you may have rights relating to your personal information, including rights to access information about processing, request correction or updating of inaccurate information, request deletion or erasure where applicable, withdraw consent where processing is based on consent, raise a grievance and exercise other rights provided under applicable data-protection law. Where customers submit reviews, photographs, videos, comments or testimonials for publication, the submitted content may be displayed publicly when the customer chooses or consents to publication. Customers are responsible for ensuring they have permission to share personal information or images belonging to other individuals.
